Question for the mods, what happens when a model posed for another company say pinupfiles for example and later onwards the model herself requests to be put on the DNP list. Is the content shot of her that is owned by the studio allowed to be posted? In this scenario DMC TDR wouldn't apply if it came from the model herself as she would have signed her image rights to the studio regarding that particular content.
I am glad that
@Ptar caught this, as I would have missed it (it was only by chance that I stumbled across it).
So, in the future, if you, or anyone wants to bring something to the attention of one, or more staff members, you got to use the
@Username in order to ensure that it happens.
Or, even submit a Report against your own Profile, and ask there (no worries, Reports are not used against the Reporter, and other than some members being informed, "Report received...", they do not know who the Reporter was).
Now, regardless of who the model signs up with, most Photographers/Agencies have her sign a Model release form. Then, all the media taken/produced becomes the property of that photographer/agency.
So, if she should sign up with another Photographer/Agency, usually the same thing happens.
So, it would be up to the photographer/agency to request the media be removed.
Now, if she is working for Photographer/Agency "B" and sees her content from Photographer/Agency "A", her best course of action, would be to contact the old company, as contacting the website directly may not her best course of action (we actually had a former Photographer/Agent do this on a model; he wanted us to remove both her content by him, and her publicly available IG content
- Unless she contacted us, her thread (minus copyright content) is still here; no I do not remember who it was).
However, if a paid model working for Photographer/Agency "B" contacts us, we do have the right to either tell her, "Only the Photographer/Agency "A" or the o/p can request thread removal." Or, we can try to stay on her good side, and delete it (much depends on how the model acts).
...Ok so hypothetically speaking, say I took some photos and videos of a model with her consent and then posted them on here would that be allowed? What about Cel or any other porn producer?
If you did not have her sign a Model release form, then we would be legally obligated to remove the media.
Now, Cel knows his stuff is being posted here. And, he usually takes it in stride. But, yes, he has submitted a TDR (Take Down Request) once, or twice, that I know of.
